GOVERNMENT ISSUES WARNING CONCERNING CERTAIN COMPANIES DEALING WITH PERSONAL INJURY COMPENSATION CLAIMS

A warning has been issued by the Ministry of Justice (MoJ) concerning 3 unregulated claims management companies who are involved in accident injury claims.  It is believed that the companies are trying to avoid being subject to regulation by being based outside the UK.

The warning came from the MoJ’s Claims Management Regulation Unit, and suggests that the following 3 companies may be providing accident claims management services without having the required authorisation:

  • - National Compensation Consumer Line

  • - Compensation Consumer Survey Line

  • - Personal Injury Hotline

Each company is making unsolicited telephone calls to consumers seeking personal injury claim details that they then hope to be able to sell to businesses that handle accident claims.  This tactic is known as “cold calling” and which is now illegal.

Despite enquiries, the MoJ has been unable to identify the people behind these companies or make direct contact with them.  They have therefore issued the warning and members of the public should be extremely cautious if the companies get in touch.

The MoJ has also appealed for information from anyone who has received an unsolicited telephone call, or who has been offered the chance to buy accident claim leads, or who knows of anyone who is already receiving leads from any of these companies.

COMMENT:-

The area of personal injury compensation is now subject to strict regulation, but there will always be those who try to avoid playing by the rules in the hope of making easy money.

Before signing up with any claims management company, people may want to consider whether to contact compensation solicitors direct.  The claims companies simply sell accident claim details to such solicitors, and despite the glossy advertising on TV and in the press, the companies themselves are not able to handle the legal work involved.

Anyone who has had an accident and needs guidance on which firm of solicitors to use in seeking compensation might want to contact their local CAB or call the Association of Personal Injury Lawyers (APIL) on 0870 609 1958 for details of specialist solicitors.  An APIL solicitor will ensure that the injured person receives all the compensation recovered, which is something that cannot be guaranteed by all claims management companies.
