COMPENSATION PAID WHEN DIESEL SKID ENDS IN TRAGEDY

Motorcyclist Richard Cooper was tragically killed in a motorcycle accident when his bike skidded on a large deposit of diesel fuel on the road, which caused him to collide head on with a van travelling in the opposite direction.

His family made a claim for personal injury compensation against the Motor Insurers Bureau (MIB) and has been awarded the sum of £110,000.

Normally, claims made by people injured in a road accident are directed against the party who caused the accident and handled by their insurers. However, the MIB will deal with all such claims where the negligent party either has no insurance or, as in this case, is unknown and cannot be traced.

Diesel on the road can often be as a result of a spillage caused when the drivers of commercial vehicles overfill their tanks. However, road accidents like this do not happen only to motorcyclists and are not just caused by deposits of diesel. Other liquids spilt on the road may have similar properties to diesel and could render the road surface slippery and dangerous. Also if a lorry carrying sand or gravel lost part of its load, for example when going round a corner, this could result in the similar serious consequences.

COMMENT:-

People often do not realise that they can make claims for accident compensation for their injuries and financial losses following a road accident when the party responsible is uninsured or unknown. This particular case is believed to be the first occasion when the MIB has accepted that this type of road accident comes within its scheme, and this should provide a basis for other similar claims to be successfully concluded in the future.
