Is a Court hearing necessary?

In only a small number of cases is it necessary to issue Court proceedings, but even when this is required it may still be possible to settle your claim without actually having to attend a Court trial.

Court proceedings may be necessary when your opponent denies liability in whole or in part, or accepts liability but the amount of compensation cannot be agreed.

Legal time limits apply to personal injury claims and Court proceedings must be issue within 3 years of the date of the accident (or discovery of a work related disease or illness), for otherwise the claim may be lost completely.

If the claim cannot be resolved by agreement, a Judge will consider all the evidence and then reach a decision which will bind everyone.
