If the person I want to claim against isn’t insured can I still claim?
If your opponent has sufficient assets to pay the compensation and legal costs awarded in a successful claim, then you can still make a claim against them. Many local authorities and statutory bodies are self-insuring and it is perfectly safe to claim against them. There are also car owners who drive without insurance and cause accidents, but in that situation so long as the driver and car are identified a claim can be directed against the Motor Insurers Bureau, who will settle the claim as if the driver had been fully insured.
