Truck, Lorry and Van Driver Compensation Claims

A substantial part of my firm's caseload consists of accidents suffered by professional drivers.  My staff and I fully understand the technical issues that can arise with complex equipment such as trucks, trailers, FLTs and pump trucks etc.  My firm has long and successful experience representing professional drivers who have been injured during the course of their work, and who have sought redress against the negligent person or business guilty of causing their injury.  Increasingly this includes female drivers, who are no less exposed to the dangers of the workplace than their male colleague.

                                                                                  

Strangely, most accidents occur during the loading and unloading process and not while driving.  If an accident is caused by the negligence of your employer or a work colleague, a compensation claim can be made against your employer, who is responsible for your safety and the actions of other employees.  If the same situation arises on third party premises, eg the depot to where you are delivering or collecting a load, then similar liability rests on the company occupying the depot.  

Common work related accidents leading to successful claims include:-

  • Falling, slipping or tripping, eg in shops, hotels, restaurants, factories and offices.  Accidents can be caused by wet or slippery floors, worn floor coverings and obstructions.  It does not matter if the accident was inside or outside in a yard.

  • Due to unguarded or faulty machinery

  • Defective premises or equipment

  • Lifting or manually handling items

  • Inadequate safety or protective equipment

  • Guard dogs should be with an experienced handler and there must be visible warning notices. 

But you may not have suffered an accident at all but due to your working conditions or practices you begin to suffer from an illness or disease.  In such a case the claim for personal injury compensation would normally be made against your current or a former employer.  The employer (by their insurers) for whom you were working when you contracted the disease may be liable to compensate you  if they were aware, or ought to have been aware, of the risk that you might become ill but still failed to protect you.

Diseases or illnesses leading to successful claims include:-

  • Deafness

  • Exposure to dust/fumes

  • Asbestos related conditions

  • Repetitive strain injury (RSI)

  • Skin conditions (eg dermatitis)

  • Hand or arm vibration syndrome/vibration white finger

  • Asthma

  • The driver of a vehicle (eg a car, van, bus, truck, lorry, motorbike/motorcycle, bike/cycle) injured in a road accident caused by another driver.

  • A passenger in a vehicle (eg in a taxi, on a bus, travelling in a friend or relative’s car or a truck drivers mate) injured in a road traffic accident caused either by the driver of that vehicle or by another driver.

  • A pedestrian or a cyclist injured when knocked down by another vehicle.

  • Potholes in pavements or roads.  Accidents can be caused because the area is uneven, pitted, worn or in a poor state of repair.  Claims are usually made against the Local Authority responsible for maintaining the area.
