Rehabilitation Care for Victims of Personal Injury
The purpose of rehabilitation is to restore an injured person to as productive and independent lifestyle as possible through the use of medical, functional and vocational intervention. So, how does this fit with personal injury law and procedure?
As long ago as 1880 it was declared by a senior Law Lord that the purpose of the award of damages was to “put the party who has been injured in the same position as he or she would have been if they had not sustained the wrong for which they are now receiving compensation.”
In many cases rehabilitation can help injured people recover more quickly, have a better quality of life and return to work sooner. Rehabilitation can be the key to returning the injured person to the same position they would have been in were it not for the negligence of the person who caused the injury.
The only remedy in court cases involving personal injury is money, but in most instances rehabilitation should be considered as part of the package and be paid for by the opponent. As with all other damages, the court will allow the cost of rehabilitation to be recovered as long as it can be shown to be reasonable.
An injured person is not merely to be provided with the cheapest rehabilitation and care provision possible, but is entitled to have what he or she reasonably needs to enhance their lifestyle, in an attempt to try to restore it, as much as possible, to how it was prior to suffering the injuries. Often, the cost is paid by the opponent or their insurers direct to the medical practitioners providing the treatment, eg physiotherapists.
Solicitors involved in personal injury, and also industrial illness or disease cases, should consider whether rehabilitation is appropriate in every case. The reasoning behind these provisions is to enable the injured person to recover sooner, more fully and able to return to a normal life sooner, rather than waiting for the litigation to conclude.
Successful rehabilitation may mean that the final compensation award could be less, but the ability to get well, suffer less pain and return to work earlier is of more importance than a larger reward of compensation.
